
GAMBLING AND THE LAW
With the aim of being as comprehensive as possible, we thought it would be interesting to add some information about the legal situation. This article is based on the 2006 situation.
Regular changes on laws and regulations proper to each country are mentioned here in the NEWS. Two continents govern differently the law on online gambling: on one hand, the American continent and on the other hand, Europe.
IN THE UNITED STATES
In the United States, since 2006, a law, decided by George W. Bush, forbids online gambling throughout the territory. It must be noted that in the United States, most of the laws on gambling were created in order to fight organised crime. In fact, it is forbidden for American financial institutions to allow transactions related to the activity of online gambling. Notwithstanding the catastrophic financial consequences for many online gambling businesses, some Internet sites are still accepting American players and financial intermediaries, such as Neteller.
Antigua and Barbuda, wronged by the decision of the American Senate, asked to the World Trade Organisation (WTO) to impose a fine equal to 3,44 billions dollars on the United States for having forbidden the American people to bet and to play on Internet sites hosted in the West Indies. Let’s remember that in 2005, the West Indies had already won the sentence passed by the WTO. It must be known that since the W. Bush’s 2006 law, millions of American players have been playing on sites hosted abroad and especially on sites hosted in tax havens or in Europe (United Kingdom or Malta).
WHAT ABOUT EUROPE?
In Europe, it depends on the country. In the United Kingdom, games and stakes have become a national institution. Online casinos are in the process of being allowed. In many other countries, they are tolerated but new laws will probably appear very soon.
In France, only PMU and the Française des Jeux have the exclusive right to use the Internet to encourage people to play online. However, by order C-65/05 passed on 26 October 2006, the European Commission who sentenced France, is taking measures to remove the obstacles to the provision of sports betting services. Greece and Sweden will be sentenced too.

Actually, the European Commission considered those obstacles as being a violation of the principles of the free circulation of goods, of the freedom of establishment and of the freedom to provide services. The French legislation would fail in the EU’s rules because it forbids to competitors to settle in France and to provide Casino games, online poker or sports betting.
Will EU govern this area? It is too early to think that a European regulation would appear in the next few months, but it is on its way. The Baraka casino, for example, that satisfies many selective ethical and financial requirements, got a Maltese license for the use of its casino (BG Enterprises Limited utilizes Casino Baraka and Casino Vendôme).
Let’s remember that the United Kingdom and Malta are willing to legalise online gambling.
